The process of transferring ownership of a legal title of real estate is known as conveyancing.

The preparation, execution, verification and lodgement of the legal documents involved in the transfer of a land title generally require the services of a solicitor or professional conveyancer.

Conveyancing typically involves three stages:

  1. Pre-contract – In the first stage a buyer seeks a property that meets their needs and wants.
  2. Processing – During this stage negotiation occurs, ensuring each party is happy with the condition of sale including property/land description, price and all conditions.
  3. Post-completion – The property ownership has been transferred.

Each Australian state has their own set of rules and regulations to govern conveyancing so it is important to choose a conveyancer that not only understands your unique situation, but is actually located within the same state as you. Based in Werribee and Moonee Ponds, we service clients across Melbourne’s west.

Property conveyancing legislation in Victoria requires sellers to provide a disclosure document known as a Section 32. The Section 32 details title ownership as well as easements, covenants and restrictions on the property. It will also include council zoning information, measurements and boundaries, recent planning and building permits, and relevant outgoings. MCB Law can prepare and review Section 32 documentation, providing sound legal advice and guidance throughout the process.

MCB Law also prepares and executes contract of sale as part of our conveyancing service. The contract requires certain details be included to ensure its validity. These details include the names of both the vendor and the buyer, the purchase price, deposit paid, settlement owing, settlement date, any clauses, GST information and details of any real estate agents involved in the sale. The team at MCB will work closely with you to ensure you fully understand all elements of the contract before execution takes place, protecting your interests at every stage of the process.
